Search the internet for Java files that have the extension .jar (these are executable Java files). Not all of them will work. Some are especially for Nokia or other brand phones. When a calls come in, you will be presented with an option box. Press that key and a menu will appear. One of the items on the menu will allow you bring up the sound recorder to tape the entire conversation as a sound file for playblack at anytime. How do I change my ring tone?
Tone volume and set up is found by pressing PROFILE icon and not the SETTINGS icon. Once in profile, select GENERAL and then CUSTOMIZE. You will be given the opportunity to change ringing options. How do I get the webcam function working on this phone?
When you plug in the USB charging cable, you’ll be presented with a screen to either use the phone as a storage device (for transferring files) or as a webcam. Choose webcam and the phone will display a picture of a webcam. It’s now working as a webcam and transmitting what it sees to the screen. You will be taken to another menu that will allow you adjust settings like how long before the answering machine picks up the call and how long your caller’s message should be. When an actual call comes through, the answering machine will save your calls to the memory card and you can review them at anytime. I hear that the phone has “In Call Background Noise”. What is that? As far as sound effects go, if you use this feature – you decide what background noise your caller hears when they’re talking to you. You can set the background noise so your caller thinks you’re in a restaurant, in the subway or a host of other settings. Perfect for the devious in all of us. How can I change the placement of my icons in the main menu? There may be certain icons you want closer to the first page, in which case the Odyssey phone was designed to allow you to move the icons about just like you would do on your computer desktop. Simply place your finger or pen stylus on any icon for more than 3 seconds and all the icons will start shaking. This indicates you are in icon moving mode. Locate the icon you want to move and place your finger or pen stylus on it for more than 3 seconds. It will increase in size indicating that you can move it. Just drag it to the new location. When you’re done moving icons, press the black select button at the center of your phone to exit icon moving mode. How do I setup a wake up alarm?
Click on the CLOCK icon. You will have the ability to setup 6 different alarms depending on frequency and day(s) of the week. You mentioned that you can setup a different ringtone for each caller on your contact list, how do I do that?
It’s really easy. Simply press the CONTACTS icon on the bottom of your screen and select “caller ringtone”. Solid is the best word we can think of to describe the tactile sensation of holding the Odyssey in your hand. As cellphone aficionados, we test our fair share of phones for professional and personal reasons. For us, cellphones that have in the past provided exceptional feel in your hand quality has been any of the Nokia N series especially the N95. Going farther back, the Siemens S40 felt great to hold as well. We’re not big fans on the iPhone though because it’s too wide and too thin for our tastes. It feels like you’re holding a calculator in your hands not a mobile phone! The Odyssey CVDQ-M56 on the other hand is the epitome of a touchscreen phone in a candy bar form factor. It’s narrower than the iPhone, but just slightly thicker to give you the impression you’re holding something solid in your hand. Of course, the fact that it’s well built accounts for that too. But the smooth black face and the rounded chrome corners lends itself to a phone that’s as well-designed aesthetically and tactilely, as it operates superbly. Can you tell what’s the difference between the CVDQ-M56 Odyssey phone and the CVDQ-M50 Voyager phone?
From the perspective of firmware and functionality, they’re almost identical. The Odyssey phone has a larger screen though. It’s 3 inches compared to the Voyager which has a 2.8 inch screen. At the bottom of the screen there are four main icons: phone, contacts, opera, and music player? Is there any way I can change those or are they permanent?
Yes, the four short cut icons can be changed. Simply press and hold one of the icons in the main area and the entire icon set will vibrate. Next select the icon you want to become a shortcut and it will increase in size. This shows it can be moved. Then simply drag it into the shortcut icon area and it will replace the one you dropped it on. When I am entering the name of a new contact in my phonebook, what is the maximum number of characters I can use?
You can enter a name that is 14 characters long. Where are the accelerometer settings for image rotate?
Image rotation is achieved by viewing a photo and touching the screen. A rotation icon appears that allows you to switch from portrait to landscape mode and vice versa.

got my phone yesturday very impressed of how small it is for what it can all do! after spending a day with it to get to know my new fun phone, this is by far the best phone i ever had! I recomend this phone to anybody who wants a tech swavy phone with out breaking your wallet. me living in the usa, the tv app dosent work cause its anolog signal not digital signal and camra not the best, but its takes ok pictures. but other than that. Clear thinking is the ‘new Green’

Regularly billed as ‘The world’s leading expert on the brain, memory and

Educating the educators

Tony recently returned from a six-week lecturing and interview tour of Asia and the Far East. In HCMC, Vietnam, he was invited to brief the Vice Minister of Education on his ways of creative thinking and learning. She has since asked Tony to consider providing input for training manuals which are to be distributed to all the teachers in Vietnam – numbering several millions – thereby training themselves and then educating the children for whom they are responsible.

Mexican Brain Waves

Tony has enjoyed a long-standing relationship with the government of Mexico,stretching back to the turn of the century and the election of President Vicente Fox of the PAN (National Action Party). A highlight of his career in Mexico so far was in 2003 – the 5th annual United Nations Conference on Quality and Innovation at the Mexico City Stadium – where Tony was the keynote speaker for the whole event. In addition, each of the other 28 speeches delivered was simultaneously Mind Mapped by a total audience of 10,000 people, led by the Buzan Centre’s Latin America team, headed up by Jorge Castaneda – that’s around 280,000 Mind Maps created over the duration of the conference!

Another highlight was when Tony was honoured to be given the prime keynote slot -addressing an audience of 15,000 – at the Farewell Convention for the outgoingPresident Fox, when he completed his term of office in 2006.

Tony’s teachings and systems were instrumental in helping to structure the election campaign which put Foxe in power in 2001, becoming the first Mexican opposition party President since 1929. Much of the ‘outreach’ campaign was planned with Mind Maps, as were many debates and political arguments. Fox’s victory was decisive (43%). One outcome of Fox’s Buzan-inspired strategy was the development of an operations manual, based largely on Tony’s Mind Mapping and learning techniques,for all senior parliamentarians, ministers and civil servants.Apart from the ex-President himself, one of Tony’s most dedicated Mexican followers is Buzan Licensed Instructor Antonio Obregon Torres, who for many years worked as a senior government official, reporting to the Mayor and Governor of Guanacuato. The Mayor presided over a massive, wide-ranging series of Buzan Learning events, reaching audiences as varied as civil servants, learning professionals, and underprivileged children – publicly supporting Mind Mapping and Mental Literacy. So dedicated was he, that he then qualified as a BLI himself – using Mind Maps to plan his campaign for election to the Mexican Congress. With Mental Literacy in Education as major planks within his programme, he won by an unprecedented majority of well over 70% – thus becoming the first BLI to become a Congressman.

Tony’s ongoing relationship with Mexico is warm and continually expanding. On his last visit he spent time with Sergio Garcia de Alba – the former Minister of the Economy, and now the brains behind the initiative for renovating the number one private University in Mexico, Tecnologico de Monterrey – helping him to evaluate the benefits of a long-term alliance.

Also on that trip, and for the first time ever in the Americas, Tony trained 40 people in Stage One of the new Buzan Learning Certification programme, The Mind Map Foundation Course. He also visited the site of the impressive building in Jalpa that will house the Mexican Centre for Research and Development of Intellectual Capital, which will incorporate a State Buzan Centre. A further return visit, incorporating an itinerary of conference appearances and workshops is planned for the last two weeks of October 2007, when the new Centre will be officially opened by Tony.

Chinese inroads

In China, the government-owned Foreign Language Teaching and Research Press FLTRP, is the publisher of seven of Tony’s books, with more in the pipeline for 2008 and beyond.To back up this initiative Tony regularly speaks, at the invitation of the Chinese government, to large audiences of leading business people. He also gives regular lectures on educational techniques at key learning centres such as Beijing University.

Tastes of the Orient

In Malaysia, Tony has worked closely with former Prime Minister Mahathir Mohamad, a renowned ‘blue sky’ thinker, whose vision was to be a leading first world nation by applying Mental Literacy techniques as a foundation concept. Another big Buzan Learning supporter is former Minister of Transport and current President of UTAR University, Tun Dr. Ling, who is heading up an initiative to introduce Mind Mapping and its applications into future business and educational strategies throughout the country.

Singapore fling

Tony has been equally busy in Singapore, where he leads an initiative with IPAN, the Civil Service branch of the Ministry of Manpower, to train thousands of senior and middle-level civil servants in thinking, creativity, communications and a full range of complementary learning skills. Instrumental to his success – in the city-state and beyond – has been his close relationship with Henry Toi, founder and Managing Director of Buzan Centres Asia – who, under Tony’s direction, has in recent years established Centres in Korea,Indonesia, the Philippines, Vietnam and Thailand.Tony has also been involved in implementing an ongoing programme, organized jointly with the founder of Buzan Learning Centres Singapore, Dr Tan Buck Chye, to help the nation’s teachers to teach and communicate, using Mind Maps and Buzan Learning literary techniques. Thus far at least 5,000 of the 20,000 teachers

in the country have attended courses, which are always immensely well received.

School’s out…

The pair has also recently commenced a far-reaching, experimental educational concept, The Power Learning Camp, which arranges for children to go, out of school, to the Learning Centre. Here they are tutored, by qualified academic teachers, curriculum subjects such as English, Geography, Chemistry and Physics.

The teachers are all qualified to teach these subjects, and have been furtherqualified by Tony himself and the Buzan Centres, to utilise Buzan techniques throughout.

For instance, the physics teacher who teaches physics with Mind Maps also teaches them how to read faster, how to take notes… and how to translate these notes into essays. This is a major social and educational experience which is proving to be extremely popular with teachers, parents and children alike – and the school is currently overflowing.

Back on home territory

In the UK Tony has, in recent years, been involved with a number of large-scale regional government educational authorities, including a far-reaching programmerfor Bedfordshire Education Council.In Scotland, he is a key member of the Masterclass team operated by North and South Lanarkshire Councils’ The Tapestry Partnership – and has lectured to more than 5,000 head teachers over the past seven years. As part of this initiative, in May this year he lectured to 200 head tearchers at The Glasgow Royal Concert Hall on ‘Strategies for the 21st Century’ – an important element of the two councils’ ‘School as the Home for the Mind’ strategy.

The main markets for online gambling has always been in the US and Europe. Not until the US congress took a firm stance against online gambling, banning credit-card companies from taking payments from such sites. Sushi Making Through Cooking Games

Chef Anthony Bourdain, the popular host of the TV show No Reservation (Travel Channel) and the unofficial food expert of the world’s different cuisines, was once interviewed in a local lifestyle magazine if he gets jaded with the food that he gets to taste around the world. I cannot cite his answer verbatim but the gist of his response was this: Yes, he does get jaded with the food but that is only limited to some regions in Europe. In Asia, however, he could never feel jaded because, in his own opinion, in China alone, he could eat different recipes everyday for the rest of his life and that is the tip of the iceberg.

It only goes to show the variety of Asian cuisine: from the mostly spicy Thai cuisine, the mostly raw Japanese food to the varied influence found in Philippine food (Chinese, Malay, Spanish and American). When we say food, what comes to mind is that it is first subjected to heat in whatever form. With that in mind, it is hard to imagine how Japanese food came to be defined as such, but it is still food and Japanese food brings one of the most unique eating experiences. As for me, I have always been a fan of sushi. But I have learned how to make sushi in the most unconventional classroom: the online cooking games. 

Cooking games have been around quite a long time now and they usually attract their fair share of devoted fans. I have never been one of those devoted fans of cooking games but I admit to playing cooking games once in a while. I never thought that I would get anything educational through it but funny enough, I did. I found out through cooking games that to make a good sushi, make sure that the fish is very fresh (as it is eaten raw). You slice it in thin strips, and then you wrap it inside rice shaped like a ball. Then you get a thin film of seaweed and put the rice there. Before rolling the rice and the seaweed, make sure that the seaweed is place on a wooden mat used to roll the sushi (All these could be brought at the nearest Japanese convenience store). Once all the ingredients are tightly packed, you can now take out the wooden mat then slice the roll into easy to bite sizes. Get your favorite wasabi sauce and give your sushi a deep. Remember not to put too much wasabi sauce for it is very, very hot to the tongue. The sushi is now ready to eat so you may feel free to enjoy. 

These few instructions could be better understood if one plays sushi making in the aforementioned online game.  Just by looking at the graphics one could easily follow the simple steps in sushi making. Who said that games have no any useful benefits to man does not know what he is talking about.

Reflections on the Obama generation

It is little over a year since Obama won the 2008 Presidential Elections; in truth this was when his presidency began. The day after his victory he called his transition team together for a morning of brainstorming and planning. From November 4th to his inauguration on January 20th he played an unprecedented role in the affairs of the nation and carefully laid the groundwork for his presidential term. Yet how are we to assess this first year and the movement that brought him to power? An exhaustive answer to that question is not possible but here a few observations, on four key issues, made during my time here which may be of interest to some.

Health Care

Obama’s first major domestic move has been health care. Sadly, the bill that passed in the House of Representatives 10 days ago is a pale reflection of what Obama promised (or appeared to promise), a long way short of other first world countries (and even some third world countries) and significantly less than the American public needs. It looks to be more like a reform of the insurance industry than a real viable opportunity to offer universal and/or affordable health care to all. The health care industry accounts for 16% of total GDP, the highest in the first world and yet there are currently 50million uninsured Americans, and many whose benefits do not allow for adequate treatment. As the recession deepens this number grows.

At its core the bill creates a federally regulated marketplace where consumers would be able to shop around for the best insurance plan. This includes state subsidies to some private plans for certain consumers and, most controversially, a state run insurance plan.

The good news: The bill extends coverage to an estimated 34million people, requires more employers to offer decent health care benefits, reduces the cost of health insurance in general, expands Medicaid coverage, offers subsidies to small business and individuals, increases taxes of high income earners (over $1million) and prevents insurance companies from denying coverage and/or charging higher premiums for pre-existing medical conditions.

The not-so-good news: In a “compromise” move any state subsidized or run plan excludes abortion coverage except in the case of incest, rape or where the mother’s life is in danger. Undocumented immigrants would not be eligible for any plan involving state subsidy, tax credits or for Medicaid or Medicare (state insurance programs for the poor, elderly and disabled). They are, however, able to purchase private insurance through the market place at the full price that few can afford and access emergency care at unnecessarily high cost to the state. There will be no “public” health care in the sense that Canada, most of Europe and even South Africa offers, i.e. free public health care services. Rather state subsidized or run insurance programs would pay private doctors medical-aid rates as private insurances companies do (and not significantly reduced rates as some hoped). The privatization of health care continues. Most damming, however, is that most of the funding may only come into affect in 2013 despite the growing number of uninsured. And even this modest reform bill will most probably not make it through the more conservative Senate in its current form. Most telling is the extremely muted resistance (and even silent acceptance?) by the health care industry to this plan.

The Long War

Obama seems to be making positive moves on a gradual withdrawal from Iraq despite none of the objectives (securing foreign oil, stabilizing a client-regime and “countering terrorism”) having been achieved. Some enthusiasm can be taken by the progressive (albeit agonizingly slow) attempts to close Guantanamo Bay (which Obama admitted will not meet the promised deadline) and the decision to try Khalid Sheikh Mohammed and his co-accused (allegedly implicated in the September 11 attacks) in a civil court in New York. Likewise Obama’s reaching out to the Muslim world and his diplomacy with Iran is a sharp departure from previous policy and sorely needed.

However, Afghanistan remains a weight around Obama’s neck and a quagmire he appears to be sinking deeper into. At the heart of the problem is long-term American military strategy. Official policy follows the idea of “The Long War”; a 50 or 100 year counter insurgency cold-war against Al Queda and Co. along the “arc of crisis” mainly oil rich, Muslim countries such as Iraq, Afghanistan, Pakistan, the Horn of Africa, the Philippines and beyond, with various “hot-wars”, as we have seen, along the way.

The term “Long War” was coined by Gen. John Abizaid in the 1990s and is promulgated by counterinsurgency experts around the Pentagon and think tanks led by the Center for New American Security. Its most ardent advocate, who popularized the idea in 2005, has been Dr. David Kilcullen, a top military advisor and current aide to Gen. Stanley McChrystal, and the case is made for it in his recent book The Accidental Guerrilla. Despite the failure of global counterinsurgency tactics the strategy has gained dominance in military circles.

This is the quagmire that Obama faces; Afghanistan (and its surrounding conflicts, in Pakistan for example) is not an isolated fight that can simply be “won”. Rather it is a single battle in a larger plan, one with dubious military and political gains, clear moral inconsistencies and enormous financial implications that will undermine all domestic policy.

The Environment

Positive talk abounds. Obama’s address to the United Nations on September 22nd was the first progressive thing to come from an American President on the environment in a long time. He acknowledged past American failure and the gravity of the threat and said he was determined to act for the sake of future generations. A host of public meetings of high level officials and other important role players have taken place. Despite being watered down the stimulus plan offers: “$24.4 billon in real money for energy efficiency, $25.3 billion for renewables, and $23 billon for transit improvements… According to Clinton and Obama adviser John Podesta, the package means $150 billion in clean energy investments yearly for 10 years, creating 1.7 million net new jobs”6. Obama’s meetings with foreign leaders have also managed to produce positive statements on the need to tackle green house gas emissions.

However, very little of the American plan has been implemented to date, although in fairness these programs take some time. More importantly though is that eloquent speeches have not included concrete targets, this is true for Obama’s UN address and (as an example) his statement after meeting China’s President Hu Jintao. Even more disappointing to climate change activists is that the upcoming Copenhagen Conference appears to be dead in the water with a non-binding political agreement the likely outcome which, optimistically, is a stepping stone to a binding agreement with real targets and, realistically, a face saving move.

Why lay this at Obama’s feet? It would not be fair to do so entirely, but we must acknowledge that progress on this front is not possible without American leadership and at times arm twisting of other countries, clear commitments to specific targets and actual restrictions of its own domestic economy.

Economics

Those who expected a radical change in economic policy with the assent of Obama to the White House have been sorely disappointed. The expectation was, of course, completely unrealistic. Obama’s economic policies do not vary greatly from those who came before him, whether Democrat or Republican. To choose but three examples…

Bailouts: The astronomical chunks of money given to banks and other financial institutions and the terms (or lack thereof) on which this money was given in both the Bush administration bailout (of which the Obama team tacitly approved) and Obama’s stimulus package do not indicate any shift from the prevailing neoliberal economic policies. Despite strong talk very little has been done to regulate the financial sector in the wake of the 2008 crisis. Obama’s enthusiasm for the “jobless recovery” of the stock market (i.e. investors are making profit whilst workers continue to lose jobs) is another indication of his mainstream market-economy approach (the system is fine, it just needs to fixing, intervention and control). To his credit we must acknowledge the expanded public sector spending in important areas in attempts to create jobs. Again, on the flipside, this is tied up in boosting consumer spending (as the banks are encouraged to start lending) which was part of the problem in the first place.

Foreign Trade: Obama’s speeches on trade are perhaps most telling. Whether it be his speech in Ghana, his discussions at the APEC summit or his press conference with the Chinese President, the message is clear: free trade, market competition and transnational business are the key to international prosperity. Contentious issues such as American farming subsidies are not even close to the table. Of course there are nuances, talk of regulation and some positive reformist policies, but the core policy remains.

Advisors and Appointees: Perhaps most telling is with whom Obama surrounds himself. Economic advisors and appointees pre and post election are a mix of Clinton era economists (the era of greatest international market deregulation) Bush era functionaries, academic economists, big businessmen and a few reformists. Members of the Transition Economic Advisory Board include: Chairman and CEO of Berkshire Hathaway, TIAA-CREF and Xerox (Warren Buffett, Roger Ferguson and Anne Mulcahy respectively); Chairman of the Board of Time Warner (Richard Parsons); and Chairman and Director of the Executive Committee of Citigroup (Robert Rubin) – Citigroup received approximately $45billion in bailout money 8.

Timothy Geithner, the Treasury Secretary did a stint at the IMF and Lawrence Summers, the head of the Economic Council (NEC), a former top World Bank official, was forced to resign from the presidency of Harvard University in 2006 after he suggested that women lack men’s innate ability to excel at math and science9. He is on record saying that nothing can be done about both huge AIG executive bonuses (post bailout) and rising unemployment10.

What is to be learnt?

Readers of this post may be surprised to know that I’m an Obama fan. He’s charismatic, fresh, eloquent, intelligent, progressive, has good values, an awareness of dynamics of discrimination (class, race, gender and sexual orientation), is supportive of union activity, offers an inclusive international policy approach and has prioritized the right issues of health care, employment, education and the environment. And he’s African American. He is pretty much the best you are going to get within the American political system. But that’s the crux isn’t it: “within the American system”, and it’s not just the American system but the global neoliberal capitalist economic order. Obama’s hands (and mind?) are tied in so many ways.

It all comes down to economics, money, power and profit in the end. It is no secret that various lobbies and big business exercise extra-ordinary influence over members of Congress and the Executive. Campaign financing by lobby groups totaled $3.3billion in 2008 with the US Chamber of Commerce (representing big business) coming in first place with approximately $527million and different health insurers and pharmaceutical groups coming in at 2nd, 4th, 5th and 6th place with a combined whopping $712million. Not surprisingly the military-industrial complex is represented by Northrop Grumman, Lockhead Martin and Boeing Co in the top 20 spenders. Also making the top 20 are energy giants General Electric (3rd), Exxon Mobil and Edison Electric Institution. Mass telecommunication companies (AT&T Inc and Verizon Communication) Financial Giants (Freddie Mac and the Securities Industry & Financial Market Association) and General Motors round off the top 20 list11.

We must remember the fundamental driving force of the market economy: profit; and anything goes – exploitation, environmental degradation, war etc – in pursuit of this. Not only does this shape our economic relations but also our social relations and the very fabric of our society.

Members of Congress also have their own agendas. A recent report by the Centre for Responsive Politics tallies a total of 237 millionaires in Congress. And not all are Republicans with Democrats making up 4 of the top 5, and the top 2 are from the liberal state of California. To make matters worse the top 10 industries invested in by Congress men and women include: real estate; entertainment (read media); securities, investments and banks; oil and gas; manufacturing; and pharmaceuticals/health products12.

Playing a secondary, but significant role, are the ideological groups, such as the conservative Christian right and libertarian anti “big-government”  who manage to shape the debate in distorting and damaging ways. The distortion of the health care reform program with downright lies such as “death panels” being vigorously advanced and the subsequent mobilization against health care, by ordinary people who stand to benefit the most, was scary to behold. Additionally there is a dangerous racist not-so-subtle subtext to all such anti-Obama-policy initiatives; the state has fallen into the hands of the enemy. Anyone willing to acknowledge structural racism or the social significance of race, as former president Carter did recently, in policy or politics is immediately labelled a racist in America’s great “colourblind” nation.

This is the ballpark within which the President must play.

What is to be done?

Firstly, we should not blame the President. It’s pointless. For now we have someone to work with, at least for some change. More than that I actually (some would say naively) believe that the speech making eloquent Obama, the Obama we saw before the election, is the “real” Obama. That Obama is interested in real change. In his recent book on the Obama campaign (The Audacity to Win: The Inside Story and Lessons of Barack Obama’s Historic Victory) David Plouffe says that every aspect of the unorthodox campaign was rooted in the idea that “the country needed deep, fundamental change; Washington wasn’t thinking long-term… the special interests and lobbyists had too much power, and the American people needed to once again trust and engage in their democracy.” 14 As he notes the very decision to make the campaign headquarters in Chicago not Washington was an aversion to the rot and corruption of current American politics. The grassroots movement was not a ploy by a self-serving politician seeking power but an organic emergence in response to the expression of his natural voice. It is this voice that has been drowned in Washington’s putrefied swamp. And it is now the job of those 300 000 odd volunteers and millions of supporters and voters to speak with that voice.

When you meet these (predominately young) people on the street, or in the universities today, and you ask them: do you support the war in Afghanistan? Many, most, will answer no. And yet the man they brought to power sends more troops. When you ask them whether they want free or affordable public health care many answer yes. And yet this is not what their government will deliver to them.

There is a growing sense of disillusionment amongst this generation – the Obama Generation. But the success of the Obama Generation – and indeed of Obama himself – will not be measured in bringing Obama to power (and hopefully for two terms); it will be measured in the success of transforming that cohort of grassroots campaigners into the next wave of political activists. Part of the magic was that, for the first time, these unseasoned ordinary people felt powerful; they believed they could make a change, and they did. Obama as an African American (and supported by African Americans) is of extra importance here; it underscored that even the most dispossessed can be powerful, that yes, some glass ceilings can be broken and some conservative thresholds crossed. It is that spirit which must be captured and harnessed in the coming years if we are to see social change of any sort. Most likely it will come in a splintered form. Different groups will emerge on particular issues: health, the war, education etc. We have seen this power expressed already in the protests in California around the cost and scope of university education. It is difficult (albeit possible) to imagine this scope of collective action two years ago. More than likely it will take a few years to emerge en masse as disillusioned individuals band together once again. Naturally it will be less people, but a critical mass is possible.

Critically a movement must emerge that places the economy at its core. Despite all the talk of Wall Street excess there has not been a single demonstration on Wall Street, no viable strong social movement tackling the economic system. Partly this emerges from the absence of a coherent theoretical perspective. This is needed in two parts. The one is direct: a direct understanding of the economic system in which we live and experimentation and thinking around viable alternatives. The other is integrative: we must learn to see the problems as connected, as part of a coherent whole, that economic exploitation, environmental degradation and war do not come from the existence of “bad people” but are cancers endemic to the capitalist system with its drive for profit at all cost.

We saw this integration begin to emerge in the late 1990s and early 2000s epitomized by what took place in Seattle, but the September 11th attacks and subsequent war, fear and restrictions of civil liberties fragmented and undermined this movement. Of equal importance is the insight that the system is not only creating “external” economic problems but has created a set of social relations that displaces human solidarity from its core in favour of competition and greed. It is only once social movements can attack their various causes, within a larger economic paradigm, that we can progress towards the real change that so many, around the world, passionately called for in the year 2008.

INTRODUCTION

The explosive growth of international financial transactions and capital flows is one of the most far-reaching economic developments of the late 20th century. Net private capital flows to developing countries tripled – to more than US$150 billion a year during 1995 to 1997 from roughly US$50 billion a year during 1987 to 1989. At the same time, the ratio of private capital flows to domestic investment in developing countries increased to 20% in 1996 from only 3% in 1990. Hence, this has effected a shift from the national economy to global economies in which production and consumption is internationalised and capital flow freely and instantly across borders.


Powerful forces have driven the rapid growth of international capital flows, including the trend in both industrial and developing countries towards economic liberalization and the globalisation of trade. Revolutionary changes in information and communications technologies have transformed the financial services industry worldwide. Computer links enable investors to access information on asset prices at minimal cost on a real time basis, while increased computing power enables them to rapidly circulate correlations among asset prices and between asset prices and other variables. At the same time, new technologies make it increasingly difficult for governments to control either inward or outward international capital flows when they wish to do so.


In this context, perhaps financial markets are best understood as networks and global markets as networks of different markets linked through hubs or financial centres.


All this means that the liberalisation of capital markets and with it, likely increases in the volume and volatility of international capital flows is an ongoing, and to some extent, irreversible process.


It has contributed to higher investment, faster growth and rising living standards. But this can also give rise to shocks and stresses resulting in financial crisis as we have all witnessed in 1997 and 1998.


Testimonies to the risks of open capital markets are the several waves of instability in the financial markets in early 1998 and again in the wake of the Russian crisis in August/September 1998. To illustrate, net private capital outflows from the five countries most affected by the crisis, namely, Indonesia, Korea, Malaysia, Thailand and the Philippines rose to US $28.3 billion in 1998, reflecting mainly the decline in net bank and non-bank lending. Meanwhile, foreign direct investment which had been one of the main sources of growth during the pre-crisis period in these countries remained sluggish in 1998, amounting to US$8.5 billion as compared to an average amount of US$17.8 billion during the period 1995 to 1995.


Global trade has experienced a slowdown over the past two years due to trade contraction of East Asian economies. Generally, world GDP and trade growth slowed in the past 1997/1998 as the East Asian crisis deepened and its repercussion were felt increasingly outside the region. Asia recorded the strongest import and export contraction in volume and value terms of all regions of the world. The dollar value of Asia’s imports registered an unprecedented decline of 17.5%. The five Asian countries most affected by the financial crisis that broke in mid-1997, that is, Malaysia, Indonesia, Philippines, the Republic of Korea and Thailand experienced import contraction by one-third.


In the context of these powerful trends, I like to discuss a few significant the issues relating to them, particularly from a capital market regulator’s perspective. Given the breadth of the topic at hand, and in the interest of keeping to time, please allow me to focus particularly on current trends and difficulties faced in the capital markets.


DEVELOPMENTS IN ELECTRONIC COMMERCE AND CAPITAL MARKET REGULATION

Developments in computer and information technology have made dramatic changes to the way the financial services industry operates. These changes are affecting and will affect every aspect of the financial services industry and offer the possibility of reduced costs in raising capital, greater efficiencies in the mobilisation of domestic and international savings and the provision of better, cheaper investment products more closely tailored to the needs of different investor segments. The convergence of computer and communications technology is promoting the development of computer mediated networks, allowing for users to communicate and transmit data and other information regardless of boundaries and distance. As communication costs continue to fall, the potential of outsourcing grows.


These changes will affect –

The way investment products are offered, distributed and marketed and the way in which investors access information about the products and entities involved;

The activities of financial services intermediaries, especially advisers, and the way they deal with investors;

The continued blurring of product and institutional boundaries, and even the scope of financial services sector itself as non-traditional entities take on some of the functions of financial intermediaries;

The methods of distribution and marketing of investment products which will increasingly draw upon the techniques of mass marketed consumer products; and

The way secondary trading in investment products takes place as greater scope for direct investor transactions and low cost competitors to established securities and futures markets becomes more of a reality.

Just as electronic commerce affects investors and providers of financial products and services, it will affect the role of corporations and capital market regulators. Just as electronic commerce facilitates activities across jurisdictional borders, it poses in clear terms questions about the practical enforceability of national laws. As well as practical enforcement questions, electronic commerce also raises issues about the role that capital market regulators should play and the effectiveness of many of the traditional regulatory approaches and mechanisms that have been employed by them. An example might be an offering of securities made without a prospectus or registration statement on the Internet by a person in a jurisdiction with which the capital market regulator has no regular contact or mutual enforcement arrangements. There are also concerns about illegal and fraudulent activity on the Internet.


In this regard, the Malaysian position is that it is committed towards a structured development of electronic commerce. Towards this end, Malaysia has proposed to introduce a National E-Commerce Masterplan. This Masterplan should focus on key initiatives which will create momentum in trading via e-commerce. Besides looking at developing the technological infrastructure such as telecommunications infrastructure and systems providing for electronic delivery of goods as well as payment, the Government is also aware that there are legal and regulatory issues which will arise with regard to e-commerce. Malaysia has introduced several sets of laws catered towards proper regulation of e-commerce known as ‘Cyberlaws’. The Cyberlaws which have been introduced include, among others :


(i) Computer Crimes Act 1997


This Act provides for a framework to counter computer offences such as unauthorised access to computer material, crimes of fraud and dishonesty through the computer, unauthorised modification of contents of a computer and so on. The Act is not limited by jurisdiction. It has effect outside as well as inside Malaysia. Where a computer crime is committed outside Malaysia in respect of computers or data in Malaysia or that which may be connected to or used in Malaysia, the crime may be treated as a crime within Malaysia and the perpetrator may be dealt with under the provisions of this Act; and


(ii) Digital Signatures Act 1997


This Act addresses issues of security and authenticity of electronic transactions and it allows for greater confidentiality and integrity of messages. It allows for businesses to use electronic signatures instead of hand-written counterparts in legal and business transactions. The Act provides for the treatment of document signed with a digital signature created in accordance with this Act to be treated as legally binding as if the document was signed with a handwritten signature.


The development of an effective regulatory framework is essential in attracting and maintaining confidence for the world in trading with Malaysian counterparts via electronic means. The regulatory framework as it stands is currently incomplete as many other areas such as electronic banking and broking are still in the process of development.


To instil confidence, Malaysia must be able to provide for regulatory certainty and coherence as well as prevent regulatory capriciousness. In relation to financial services, a major consideration is cross-border implications. The Securities Commission, as an example, is currently looking at issues relating to Internet offering of securities and fund management and broking services over the Internet. A re-examination of current laws would need to be conducted to ensure that they have not been overtaken by technology and to restructure the laws so that they are technology neutral.


As far as the capital market is concerned, the Securities Commission recognises that electronic commerce is an area where it is important that the regulatory infrastructure responds in a positive and timely way to facilitate market developments and not hinder innovation in market products and processes. We believe that there are important benefits to be gained through the Commission’s facilitation of market developments in this area for the competitiveness of the Malaysian capital market, efficiencies in the operation of our capital markets and the better making of investors at lower cost. At the same time, the Securities Commission considers that it is important for the successful implementation of electronic commerce that investors retain confidence in the integrity of the market for investment products.


LIBERALISATION VS. PROTECTIONISM


On the issue of liberalisation vis-à-vis protectionism, there has been a proliferation of multi-lateral trade agreements since the middle of the century. Such agreements provide for a framework of rules within which nations are ‘obligated’ to assure other nations signatory to the agreement of a sovereign’s approach towards international trade. For example, Malaysia is a member of, among others, the World Trade Organisation through which it is a signatory to the GATS (General Agreement on Trade in Services) and GATT (General Agreement on Tariffs in Trade), APEC as well as ASEAN, all of which have the objective of achieving liberalised trading of goods and services within specified, albeit not immediate, time frames. Through these trade blocs, Malaysia has committed itself to progressive liberalisation which essentially entails a gradual opening of the economy to foreign participants.


The globalisation of economies is intrinsically linked to the internationalisation of the services industry. It plays a fundamental role in the growing interdependence of markets and production across nations. Information technology has further expanded the scope of tradability of this industry. Access to efficient services matters not only because it creates new potential for export but also it will be an increasingly important determinant of economic productivity and competitiveness. The main thrusts of the ‘services revolution’ are the rapid expansion of the knowledge-based services such as professional and technical services, banking and insurance, healthcare and education. Responding to this phenomenon, regulatory barriers to entry in service industries are being reduced worldwide, either through unilateral reforms, reciprocal negotiation or multilateral agreements. Developing countries such as Malaysia are increasingly looking at foreign direct investment in services as an especially powerful means of transferring technical and managerial know-how, besides attracting foreign capital and investment to the country.


Malaysia has made a commitment under GATS under legal services covering advisory and consultancy services relating to home country laws, international law and offshore corporation laws of Malaysia. Under the GATS commitments, commercial presence of foreign legal firms is not available except in relation to the Federal Territory of Labuan and in such a case, their services are limited to legal services given to offshore corporations established in Labuan. However, there are no limitations placed on the provision of legal service cross-border, that is, provision of such service from a foreigner without having a legal presence in Malaysia. This may be done via fax, telephone or the Internet. As stated before, most aspects of legal services does not need the physical presence of the service provider except perhaps where a court appearance is necessary. Furthermore, a Malaysian may obtain legal services abroad without any limitation either.


Malaysia is also signatory to the ASEAN Framework Agreement on Trade in Services (AFAS). The AFAS is an agreement made within the auspices of the GATS. In very basic terms, commitments under AFAS are GATS-plus which means that liberalisation of trade is accelerated within the ASEAN region under the AFAS as compared to the world at large under GATS. Its ultimate aim is to achieve regional integration and free flow of services within the region. In achieving integration and free flow of services within the region, many issues would need to be ironed out. Issues such as harmonisation of professional standards, acceptable levels of accreditation between member countries, movement of labour in relation to provision of these services, licensing and certification of service suppliers are still under intense discussion within the Member Countries. Taking into account the different levels of economic and regulatory maturity of Member Countries within the ASEAN, it is understandable that it would be a long process of consultation before a consensus may be achieved.


LIBERALISATION OF CAPITAL ACCOUNT


A most obvious impact of globalisation of trade are pressures exerted on developing nations to liberalise their financial markets and capital accounts. However, it is important to recognise that domestic and international financial liberalisation heighten the risk of crises if not supported by prudential supervision and regulation and appropriate macroeconomic policies. Domestic liberalisation, by intensifying competition in the financial sector, removes a cushion protecting intermediaries from the consequences of bad loan and management practices. It can allow domestic financial institutions to expand risky activities at rates that far exceed their capacity to manage them. By allowing domestic financial institutions access to complex derivative instruments it can make evaluating bank balance sheets more difficult and stretch the capacity of regulators to monitor risks. External financial liberalisation in allowing foreign entry into the domestic financial markets may facilitate easy access to an abundant supply of offshore funding and risky foreign investments. A currency crisis or unexpected devaluation (such as in the Asian crisis) can undermine the solvency of banks and corporations which may have built up large liabilities denominated in foreign currency and are unprotected against foreign exchange rate changes.


The ideal free market is one that every one should be free to enter, to participate in and to leave. However, events in the recent financial crises have led many of us to believe that in the freest of markets, there is a need to ensure that free flow of capital does not destabilise the market itself.


Indeed, calls for reform have gained increasing support and credence within the international community with the unfolding of the devastating effects of the crisis beginning mid-1997. The SC’s work within IOSCO’s Emerging Markets Committee has drawn attention to fundamental weaknesses in the existing global financial infrastructure that have caused and exacerbated these effects. These weaknesses include the inordinate power of highly leveraged institutions to move markets, the destabilising force of volatile short-term capital flows and the failure of existing credit assessment systems to adequately inform market participants of increasing risk of default.


One example of this mounting consensus was the express recognition by G7 countries at their recent meeting in Cologne of the need to strengthen the international financial architecture.


There are now increasing calls for greater transparency and regulation of hedge funds and greater awareness of the dangers of volatile short-term capital flows. To rebuild East Asia and the global economy, we now urgently need to engage in a sincere discussion about what constitutes sound governance in the contemporary world.


On the domestic front, we would have to ask ourselves this question: has our financial markets kept pace with change? Whilst markets have become global, applicable rules and regulations remain predominantly parochial or local. From a regulator’s perspective, the challenge for us in a global market is to design the regulatory and structural framework which will allow the market to function efficiently, competitively in a fair and level playing field environment, ensuring at the same time that the market is not subject to highly concentrated or destabilising forces that would disrupt its functioning.


The recent crisis also shows up the need for a careful and sequenced approach towards liberalising a country’s capital account. The experiences of Thailand, Korea and Indonesia clearly tells us that there is no prescribed formula on sequencing. However, it is important to recognise that countries vary greatly in their levels of economic and financial development, in their institutional structures, in their legal systems and business practices, and their capacity to manage change in a host of areas relevant for financial liberalisation. It is in recognition of this that the IMF policy-setting committee and subsequently the Finance Ministers and central bank governors of the G7 industrial nations, in the fall of 1998, stressed that a country opening its capital account must do so in an orderly, gradual and well sequenced manner.


Issues of liberalisation versus protectionism would need to be considered at great length to ensure that a country is competitive in a global trading environment. In a developing nation such as Malaysia, a protectionist policy towards local financial services industry and industry participants have been adopted to assist the local industry to develop to international standards. In the area of financial services, for example, the Government’s stance has been that consolidation of local financial services providers is necessary to ensure the development of a core group of strong and stable financial institutions to be able to withstand international competition when the financial services markets are opened to international participants.


Indeed, the Malaysian experience clearly shows that a premature freeing up of the capital account, which was done in 1988, without the requisite reforms and institutional arrangements in order to withstand the shocks, can result in debilitating effects as was faced in the Malaysian financial services industry.


MALAYSIA’S EXPERIENCE


Perhaps the most important lesson learnt from the Asian financial crisis was the interdependence of financial markets. Even the most developed economies were not spared of the effects of the financial turmoil which began as a result of Thailand’s default on its eurobond issue in February 1997. By May, 1997, the Malaysian Ringgit was under severe pressure from currency speculators and interest rates had risen from between 7% to 9%. It was reported that Bank Negara Malaysia expended about RM1.2 billion of its foreign exchange reserves to try to stave off the attack of currency speculators. However, this was the first of many repeated attacks on the currency.


The effects of the currency crisis began to take its toll on the country in 1998. Interest rates were rising to above 11% and the Ringgit had dipped to an unprecedented low of RM4.71 in January, 1998. All sectors of the economy experienced severe contraction as access to liquidity and credit became more scarce. Bank Negara had made many attempts to quell the effects of the financial crisis through imposition of tight monetary policies and attempts to ease credit to certain sectors of the economy to no avail. But the avalanche would not stop.


Malaysia’s sovereign credit rating was downgraded by international rating agencies to just above so-called junk bond status. Malaysia was facing a serious credit squeeze. Raising international capital was prohibitively costly. Flight of capital from the country resulted in a sharp decline in the stock market which fell to levels of 250 before bottoming out in the second half of 1998.


As many of you are aware Malaysia’s response to the crisis was one that was totally unexpected by the global community. The Government decided that it needed to protect the economy from increasing global pressures on the Malaysian economy. On 1 September, 1998 the Government introduced selective exchange controls with the intention of curbing and preventing further manipulation and speculation on the Ringgit. The Ringgit was pegged at RM3.80. The Government took further measures to discourage short-term flows of money by requiring that inflow of funds should remain in the country for at least one year. On 15 February 1999, this was replaced with an exit levy for repatriation of capital. The selective exchange control measures imposed by the central bank on 1 September, 1998 were directed towards reducing the internationalisation of the Ringgit by eliminating access to Ringgit by speculators and reducing offshore trading of the Ringgit. This involved the introduction of rules relating to the external account transactions of non-residents and currency of settlement of trade transactions. However, general payments, including movement of funds relating to long-term investments and repatriation of profits, interest and dividends remain unaffected. Payment for the import of goods and services must be made in foreign currency. All export proceeds must be repatriated back to Malaysia within six months of the date of export and proceeds from exports must be received in foreign currency.


The selective exchange control regime is intended to provide the time and opportunity for the Government to institute the necessary financial reforms in the Malaysian financial markets. This is in fact in progress in the work of Danamodal (the equivalent of the Resolution Trust Corporation of the US) to alleviate non-performing loan from banks’ balance sheets and Danamodal which is to recapitalise the banks. The Government is also committed to consolidating the domestic financial services industry in having few but strong and viable financial services providers in order to be prepared for financial liberalisation.


GIVING CERTAINTY TO INTERNATIONAL FINANCIAL TRANSACTIONS AND PROTECTION TO FOREIGN INVESTMENTS


International trade and finance, because of its global nature, necessarily involves many areas which may give rise to uncertainty as to the applicability of the contract under which certain trade and financing arrangements are made. These areas range from political issues and political stability to sovereign intervention of the economy, certainty of applicable laws as well as independence of the judiciary.


The Asian lawyer will be fascinated by the rapid changes which are taking place in foreign investment law both within this region as well as in the rest of the world. In less than half a century, the states of Asia have moved through a whole range of stances which could be adopted towards foreign investment. The immediate post-colonial period was characterised by a period of hostility towards foreign investment, motivated by the belief that the ending of economic imperialism alone will bring about true independence. The ensuing period was dominated by a debate about the regulation of multinational corporations and the fear that they posed a threat to state sovereignty. In this period, laws were devised to control the entry of foreign investment and the manner in which such foreign investment operated in the host country after entry. The third and present period is a period of pragmatism where the dominant view is that foreign investment, if properly harnessed, can be an instrument which generates rapid economic development. Competition for the limited investment that is available means that each state country which is bent on a foreign investment led growth strategy must make its laws as hospitable to the foreign investor as the other state which is also bent on a similar strategy.


As much as there is competition among countries to attract foreign investment, there is competition among multinational corporations to enter host countries. Whereas previously the market was dominated by large multinationals, now, there are small and medium enterprises which can transfer more appropriate technology and bring sufficient assets for investment.


This “open door” policy towards foreign investment in developing countries is typically achieved through careful screening of entry by administrative agencies which have been established for the purpose and regulation of the process of foreign investment after entry has been made. After entry, there is continued surveillance of the foreign investment to ensure that the foreign investment keeps to the conditions upon which entry was permitted. In this regard, attitudes to foreign investment protection and dispute resolution will be affected by the new strategies adopted towards foreign investment.


In the context of the new strategies which have been developed by controlling entry and the later surveillance of operations of foreign investment, the foreign investment has ceased to be a contract based matter and had become a process initiated by a contract no doubt but controlled at every point through the public law machinery of the state. The old notions of foreign investment protection which concentrated on the making of the contract and the contract as the basis of all rights of the foreign investor would inevitably become obsolete. This transformation which has taken place is crucial to the devising of effective methods of foreign investment protection. The subject matter of the protection has also changed in that not only physical assets of the foreign investor but his intangible assets which includes intellectual property rights as well as public law rights to licences and privileges have become the subject of protection.


The proposition that contractual provisions in an agreement concluded with a host country offer little protection to foreign investment must be qualified in a situation when a bilateral investment treaty has been entered between the state of the foreign investor and the host country. The result will be different, for the contract becomes effectively internationalised as a result of the existence of such a treaty. It is a basic proposition of international law that any matter that is essentially within the domestic jurisdiction of any state could be internationalised if it is made the subject of an international treaty. The existence of a bilateral investment treaty which covers the foreign investment then internationalises the whole process of foreign investment which would otherwise have been a process that takes place entirely within the sovereign jurisdiction of the host state. But, whether this result will follow depends on the terms of the bilateral investment treaty.


As a matter of general international law, the position seem to be that a contract between a party and host country must always be subject to a national legal system. Those who seek to prove the contrary have an onerous task of showing that his accepted proposition has undergone a change. There are a few usually uncontested arbitral awards which support the view that a foreign investment contract is subject to international law or some other supranational system.


Bilateral investment treaties are obviously regarded as important by both capital exporting and capital importing states. But, these treaties are not uniform and they do not have the ability to create any uniform law on foreign investment protection. But their existence adds to investor confidence and creates an expectation of investor protection. The importance of these treaties lies in the several results they achieve. The first is a signaling function about the national policy towards foreign investment.


Another advantage is that the foreign investment contract in the context of a bilateral investment treaties could have the effect of forming assets protected by the bilateral investment treaties. This will also include licences and other advantages obtained from the government during the course of the foreign investment. Whereas without the bilateral investment treaty these licences and advantages may have been without protection under general international law, they new receive protection as a result of the wide definition of property in the bilateral investment treaty. Whether the host country did intend that its administrative decisions be subjected to international review as a result of the treaty, will remain a moot point. INVESTMENT GUARANTEE AGREEMENTS (IGA”)


The Investment Guarantee Agreement protects parties involved in an international transaction from non-commercial risks such as nationalisation and expropriation. The IGA will provide a foreign investor with the following :

protection against nationalisation and expropriation;

prompt and adequate compensation in the event of nationalisation or expropriation under a lawful or public purpose;

free remittance of currency, profits, capital or other fees on investment;

settlement of investment disputes either through a process of consultation through diplomatic channels or if such process fails, for referral to the International Court of Justice. Disputes in connection with investments, under IGAs should first be resolved through local judicial facilities. In the event of failure to settle, it would be referred to the Convention on the Settlement of Investment Disputes or the International Adhoc Arbitral Tribunal established under the Arbitration Rules of the United Nations Commission on International Trade Law.

Malaysia has concluded IGAs with about 64 trading nations including trading blocs such as ASEAN and major trading partners such as the United States of America, United Kingdom, Germany, Taiwan, etc.


TRADE DISPUTE SETTLEMENT


Another aspect of international trade is the availability of acceptable dispute resolution form. Globalisation of trade obviously involves greater potential for generating international trade disputes. The international business community looks for prompt, economical and fair conflict-resolution mechanisms. Negotiation, conciliation, litigation, and arbitration are well-known conflict-resolution devices. Direct negotiations and conciliation may resolve a conflict. However, when parties fail to solve the controversy through direct negotiations, they have two choices: litigation or arbitration.


Within the context of the GATS, there is an express provision for trade settlement dispute where countries have disputes in relation to commitments made under the agreement. The WTO have provided for procedures in relation to a dispute settlement process. The dispute settlement procedure is considered to be the WTO’s most individual contribution to the stability of the global economy. The WTO’s procedure underscores the rule of law, and it makes the trading system more secure and predictable. It is clearly structured, with flexible timetables set for completing a case. First rulings are made by a panel, appeals based on points of law are possible and all final rulings or decisions are made by the WTO’s full membership. No single country can block a decision.


Malaysia is also signatory to the Convention on the Settlement of Investment Disputes established under the auspices of the International Bank for Reconstruction and Development that establishes facilities for international conciliation or arbitration. Further to this, the Kuala Lumpur Regional Centre for Arbitration was established in 1978 with the objective of providing a system for the settlement of disputes for the benefit of parties engaged in trade, commerce and investments with and within the Asian and Pacific region.


In conclusion, as we draw close to the new millennium, it is indeed a challenge to us all to be able to grapple with some of the abovementioned issues and adopt appropriate responses.

This is a challenge of endurance and ability for those who like to attack the edge. If your attitude leans toward extreme sports then this 225 kilometer stretch of adrenaline-pumping whitewater is for you! But although it is ranked among the extreme sports, it doesnâ??t mean you canâ??t take the family to enjoy it and get them â??Wild over Waterâ?. Anyone who enjoys the outdoors and is looking for adventure will be delighted by whitewater rafting. People of all ages and athletic abilities, with no previous experience raft the rivers can challenge the rapids and enjoy the wilderness fun. The Chico River is for those seeking untamed whitewater thrills offering potentially terrifying drops, ledges, rapids and the most exciting sightseeing trip.

The Kalinga Trip

The adventure actually begins last christmas , when Roger Alcantara â?? a Manila Times photojournalist and myself had to take an almost 12 hours bus ride from the bus terminal in Espana, Manila to get to Tabuk in Kalinga Province. Our bus departure time was 10:15pm and we finally reached Tabuk at around 9:45am with about three stopovers in between, more than enough to urinate and to take a long dreamed coffee break. The best thing about taking long trips at night is you normally fall asleep because you hardly see anything interesting along the road.

When we arrived at the Davidson Hotel, a surprising twenty excited rafters are also there having their breakfast. After unloading our things in our room, had enough time to freshen up and came down to enjoy a local breakfast, we waited for Naty Sugguiayao â?? our host for this trip of never ending adventure. After loading up, we went to lawagan resort to fetch some other rafters headed by Lito Beltran, a popular photography instructor of the Federation of Philippine Photographers Foundation.

The Rafting Adventure

It was not a sunny day; imagine a kalinga mountain trekking with a freezing temperature is maybe not everybodyâ??s adventure, but a worthy experience though. Along the rough roads leading to Lubuagan, a breathtaking view of the rice terraces, waterfalls and kalingans greeting you â??Umali Kayoâ? a native tongue of saying â??Welcomeâ? will definitely make your day. As we reached Lubuagan â?? the â??start-off pointâ?, a rafting safety seminar was given. Lead rafter Danny Bravo gave us the tips on how to read the river, the paddling moves and the most important survival guide. â??If anybody falls from the raft, just go with the flow, never let go the paddle if you are not in a shallow rapid; use your feet to push against the rocks, until the guides throw you a safety rope and bang! Youâ??re back to adventureâ? â?? a line remembered by the author.

Vital to every rafting, the basic paddle commands to be remembered are, â??forwardâ?, â??backwardâ?, â??left backâ? and â??right backâ?. Finally, after life jackets were checked, the head gears are buckled, the grip on the paddles are tightened, each foot are in proper positioning and cameras are safe in a dry sealed pelican boxes, the river raft were pushed of the mooring to negotiate Class III and IV rapids. It doesnâ??t take long after youâ??ve gotten into a raft to realize this is an exciting fun filled way to spend a day. The first rapid, is just the start of a heart stopping several mile series of rapids that intensifies in its strength and power until you find yourself enjoying every second of the ride. But that is far from the end of the trip. No, there is still more white water to come along with calm sections where you can get out of the raft and frolic in the river.

Along with both of us are four raft guides conquering the wild river with a raft named â??Allasiwâ? meaning an exchange of four peace tokens â?? a gesture of the historic head-hunter tribes of Kalinga. Our fear was totally gone as the ride went on and each time we conquered a rapid, or skirted a rock formation, we laugh out loud and then branded each victory with a rousing rafters â??High Fiveâ? gesture.

In between moments of sheer adrenaline, the head rafter lectured us on the names given to a popular Chico River spots such as Angelâ??s Nightmare, Gods Playground, Dead Carabao, Piggybank, Dannyâ??s Drop (where Danny Bravo slammed into a rock and broke his tooth) and Dragons Tail. Each site gives us a different taste of adventure no one can ever forget. Sometimes it is tricky finding time to enjoy the scenery because you are so focused on the awesome wild river exploration.

It took us almost three hours for that ride, we stopped over to a flat river where we enjoy our break beneath a breathtaking waterfalls while having a snack and of course a feast for the smoking dragons. Our raft moves ahead for the second half for us to take advantage of the much awaited wild rapids and perhaps to have our photo shoot. Although drenched by the cool waters and freezing temperature, the rafters were still excited and exhilarated when they finally get back to the dry. Upon reaching â??Malaking Batoâ? â?? the drop-off point, we enjoyed a bountiful lunch by the river with a perfect aroma of locally grown Robusta coffee. This trip creates the perfect blend of natural exercise, exhilaration and serenity that will have you coming back year after year!

History in the Making

Whitewater rafting is the newest sports adventure to invade the local shore. While high-adventure travelers craving for more whitewater rafting spots beyond Central America and Africa flocked for decades to the rivers of Brazil and Borneo, the Philippines remained in the quiet depths, all but overlooked. It was in 1995 when initial kayaking was done in Cagayan de Oro with the goal of introducing Whitewater rafting in the Philippines. Long before 1995, adventure driven group however have been involved in river expeditions, studying its characteristic for more than 10 years and honing their skills in paddling the rapids. Those activities have prompted the discovery of one of the wordâ??s most exciting rapids of Kalingaâ??s Chico River.

Ned Sickles together with other Oregon natives Gary Fondren and Dr. Bob Anderson were the first to discover the sports-tourism potentials of the Chico River as a world-class whitewater rafting destination when they spot it in 1997 via satellite mapping, after which the group traveled all the way from the United States to visit the Cordilleraâ??s. Joining them on their first exploratory run were Tita Natyâ??s eldest daughter Mae Shiu who was with the UP Mountaineers then and Elmer Cabotaje who is now a boar of trustee of the Philippine Airlines Mountaineering Club.

The exploration lasted for four days; needless to say, they were impressed with awesome natural scenery, the diversity of rapid levels, and the rivers cultural, historical and political contributions. From then on, Ned and company returned every year to train native kalingans to become a professional river guides. Ned Sickles was considered the father of Chico River Whitewater rafting. He brought all the international standard rafting equipments including the latest named after the native name of Naty Sugguiyao called â??Lagunawaâ? â?? meaning a beautiful lady. The months of July to January are primetime months and have historically offered the most rainfall, highest water and most exciting whitewater rapids. So if you are planning to challenge the rapids and party in between, you have the months of February to June to plan your trip.
